no i think you can`t get insurance if your house is not up to code, every insurance company required the house to be up to code before accept to insure it , if you want to bring a house up to code there are a lot of work to do first you must update the electrical, second you must check the house insulation level, third you will want to make sure that you pay attention and put more lighting where there are dark areas, and also you must check all the Plumbing in the house, this Plumbing must be in a very good level if you want to get your house up to code

Q. Can we sue the city govt for approving plumbing work not to code?
we are the 2nd owners of our house. the house is only 4 years old. we recently found mold damage in the master bathroom. we thought it was because the shower was leaking. after my husband tore out the shower, we discovered that the shower was never plumbed. the water was going through an unsealed hole in the plywood, emptying under our house. there is no evidence of the shower ever having been plumbed. there is no pipe. all other plumbing is fine. now, our master bathroom needs to be completely replaced and our homeowner's insurance doesn't cover it. can we sue the city since the house passed inspection when it was built?

First you need to ckeck with the builder of this house and see if the blueprints even show a shower on the plan. Many times homeowners will do the work themselves to avoid hiring a plumber and passing city codes. If it showes the house had a shower in the origanal plans then you need to get a lawyer. Master Plumber seen it all good luck

Q. Home insurance how does it work?
hello, my question is, does anyone know how insurance companies decide if an area has a high crime rate? do they just go by recorded crimes that have had claims through insurance or any recorded crimes regardless? i have been interested in getting home insurance as my parents don't have it for our house and i have quite a few expensive things i would like to ensure. when i tried getting quotes from some of the big home insurance company websites, the quotes were very high (double the amount my friend got) - he lives near kings lynn in a town, i live near to stansted airport in a quiet village with a population of around 250. the crime in the area is non existant. the only thing i can think of that could be causing the higher quote is there is an old lady who lives in a bungalow on the same post code as us who has been burgled 3 times no less whilst she has been in the house. this has been the only crime in the area for years and years, i am pretty sure she does not have insurance

Home insurance rates are basically made up from the following: Ammount of coverage, type of home to be insured, location of home, claims history, prior insurance, various discounts, what deductible is chosen and your Insurance and Financial Stability (think credit). Claims frequency in an area is taken into account but not to the degree where a company will differentiate rates on a street by street basis. A wonderfull example of claims frequency making rates higher is a coastal, hurricane prone area vs a town 150 miles inland. The ammount of coverage is kind of a no brainer, a million dollars in coverage will cost more than a hundred thousand dollar home to insure. Similarly some homes are constructed differently and therefore are cheaper or more expensive to insure. Not having prior insurance is probably driving your rate upwards and also not qualifying you for other discounts (such as a claim free discount which had you had insurance you may have qualified for if you had no claims). Further, if you've had several claims in the past you obviously be rated higher since you have a tendency to file claims (valid or otherwise). Also if you have a lower deductible you will have a higher premium and if you have high deductible it will lower your premium. Lastly, insurance companies do rely on an estimate of your insurance and financial stability into account while rating your policy. Your best bet will be to sit down with an agent and ask him why your quote seems high. Hope this helps some.

Q. Would love to work from home...but what's legit???
i'm planning on having a baby this year, or early next. i would love to be able to work from home part time. but most online jobs where you can work from home seem like scams! (surveys, typing, etc.). i'm a certified insurance agent with my p & c license. i'm willing to get my life and health if it will help with my job search. i live in south carolina, in the columbia area. i do not want to have to leave my house for work purposes though. i've heard that medical coding and billing is okay to do from home, but what would i need to do that? and does it pay any good. i'm making a pretty nice penny as an agent now. i dont' want to step down in the food chain too much. please give me serious answers and advice. thank you.

Q. Roofers messed up my house. . .?
i had shingles replaced about 3-4 months ago. i went up to inspect the actic for leaks and found damage to a supporting rafter (broken), many of the rafters where cracked and the main support and the main support was cracked. during the installation, the workers were dropping the tabs from about waist high onto the roof as the were doing their work. they have come out to repair some of the damage (city inspection office found work not up to code). my question is, does there action show responsbility for the damage? they are now saying they are not liable for the damage (blaming age, foundation - all was check out prior to purchasing house, 1 yr prior, and reported in good condition.) i am having my insurance company come out to check the damage but the agent say that it sounds like it was their fault. i am not sure who to believe. all i know is that my house was find before they did any work on it and no is not. please help!!!! thank you in advance.

I believe from your description that the roofers are at fault and the fact that they came out to do some repairs shows they accepted responsibility. Your home owners insurance is not responsible and probably won't be able to help. The roofing company should have insurance to cover this damage. You should ask the roofing company what the name of their insurance company is so you can insure they are notified. If they have no insurance, they are still responsible. If they do not have insurance and won't fix it, you can ask your insurance company to pay for the repairs and if they agree your deductible would apply. The last avenue, of course, is suing the roofing company. (USA) state laws vary but the above is true for Wisconsin

Q. Filing title insurance claim?
i recently purchased a home in maryland. i have been recently notified that the title company failed to find and disclose a tax lien against the property and open building code violations that were on file with the local municipal. according to the local municipal the house is uninhabitable, an inspection of the property by a city official reveal conditions in need of repair and work that had been done that the original owner did not obtain building permits to do. all of these items were part of public record prior to my settlement. i am being told i must tear out walls etc...to have the work done up to code standards. i am concerned because if the title company had revealed these open building violations when the title search was done, i would have been able to force the owner to remedy this situation. can anyone tell me if they think this might be a valid claim against a home owner's title insurance policy? i am thinking of pursuing it with them.


I used to work for a title company so here's what I know. Now take this with a grain of salt as things work differently in every state. The tax lien, absolutely, that should have been picked up by the title company. Now either the abstractor failed to find the lien, the title clearer missed it, or the county was behind at the time of search and the lien became record after time of search. All three are possible, now, the last item I mentioned should have been caught if the lender/title company does a bringdown (a quick search a the time the mortgage is recorded to make sure no liens have been placed since the original search), the should be done on every purchase, but lenders and title companies are trying to get out of this as it does cost money to do a bringdown, but this is exactly why a bringdown is completed. Someone dropped the ball here no question about it. The code violations could be a different animal. I worked title for 7 years in NY, we only searched for violations in the boroughs of NYC, and one other county, that was it. It may not be a requirement of title to do such a search, the lender may not have required the search either. It's hard to say as I dont know the requirements of the lender or the title company. The only reason we did the code search in NYC was because the lender required it. I would absolutely file the claim. I know some counties in MD were behind when out title company shut down earlier this year, prince georges especially, but if that tax lien was of record, your deed and deed of trust never should have gone on record. The code violations may be trickly, like I said, I don't know lender requirements or title requirements for purchases in MD, but I would seek an attorney and file the claim, you'll want professional counsel in this matter to assist you. Hopefully you obtained an owner's policy at closing as this should put the responsibility to clear the matter up back on the title company to ensure you clear title to the property, which you do not have right now, good luck

Q. Have a question about housing codes and permits?
my sister and her family lost their home in hurricane ike. they are now living in a fema mobile home until they can get all of the repairs done to their house. insurance did not cover all of the repairs needed so most of their expense is coming out of their pocket so it is going to take a few more months before the house is ready to live in again. fema asked my sister and her husband if they wanted to buy the mobile home because they ar ein the process of selling them. of course she said yes and then it will become my sisters mobile home. the problem is this. they are going to need the mobile home about another 5 more months so they can finish up with repairs to the house but once they buy the fema mobile home, the permit for mobile home expires. do you think it will be hard to get a permit to keep the mobile home in city limits whil they finish working on the house? after they finish working on the house, they are going to buy some land and move the home on land but as of now they have no land to put it on. fema told them they could buy it for $3000 because they usually scrap the mobile homes that people don't want. do you think there will be a problem getting another permit while thy finish re-building their house? its going to cost about $3000 to move the mobile home. if they pay $3000 to put it in a mobile home park and then 5 months from now, they have to pay another $3000 to move it again to their land. they only need the mobile home for 5 more months while they finish up the last bit of repairs.


The mobile homes have been known to have formaldehyde. There was a big stink about this a year ago, and because of it FEMA stopped selling the trailers. then they were sold as scrap. Tho Now they are being just sold. I think the hazzards of formaldehyde warrant living elsewhere for 5-6 months, esp if they have kids.

Q. Home building cost questions..( all work done ourselves)?
we have the lot in mind and the house plan . we would like to build with cash for under 100k. the house is a cape cod 4 bed 2 bath 1757sq ft and it will be on 1 acre....what are some of the first things i need to do.....we always remodel homes but never started from scratch......we know that the land needs cleared .(1 acre, flat but some small trees) can we just rent a bobcat and clear it? cost? we are going to do a crawl space foundation. cost? the house plan comes complete door knobs, screws, water heater and all for around 50k...but no air unit(cost?) water and sewer will cost 5200 and electric hook up 2000... what other cost are there? we are really simple and don't care about all the extras for now.we would like to do this farely fast and cheap.... do you think a ranch home would be cheaper ? the capes i looked at are cheaper so far but i would think a ranch would be? what about taxes, home insurance, inspections, permits and codes.how do i go about all of that? thanks..it will be in so. il. the soil is clay here and the land has already been surveyed. what i mean by cheap is finding the best deal, not the cheapest stuff. we figured that out a long time ago that cheap doesn't last as long. i am a bargain shopper though and will wait a long time sometimes to get what i want for a good price. with building a house though i know i won't have a long time to shop around if something is ready to be finished. do you think a bobcat will be good enough to do the land work? it is flat but does have some trees on it. they aren't huge because the land was cleared like 10-20 years ago but a couple are bigger. then what do i do with the clear off? just push it to the back? or bury it? what about the stumps? thanks...

You can rent a bobcat to clear the area for $300-$350/day However you can hire someone with a bobcat for $35-$50/hr You need a permit from your local city or county. Ask for the codes department, they will get you started. You will have to contact them throughout the building process to inspect your progress. Your need to have a survey - Place stakes to show how/where the house will sit on the land . Plan on $6-7,000 for the foundation if the soil is suitable for building, If not you may have to put in pears(more money) All plumbing, electrical, HVAC need to be done in compliance with your local codes. If you do this yourself make sure you know what your doing! You can probably get the minimum HVAC system for about $5,000 with no duct work. (2-3k more with) Ranch houses require more foundation, Duct work, wiring, plumbing, etc. and will cost more. Building a house is a big job...It will cost a lot more if you don't know what your doing. I acted as my own general contractor in 2001 and built a 1600sf house, it cost around 110,000 with out the lot. I constider myself to be fairly knolledgable about this stuff, I have family in the construciton business and I still made mestakes. Cheep is not (in my onpinion) the best plan to start building a home. You will end up replacing things sooner and it will cost more in the long run. BE SURE YOU KNOW WHAT YOUR GETTING INTO! Q. Will a quit claim deed work for my situation? capital gain?
my mother is interested in signing a quitclaim deed over to me. my wife and i have been living in my childhood house for over two years. my mother has her own home in a different city and both properties are paid off and mortgage free and located in california. i have two siblings (an older brother and a younger sister), my brother has told me several times that he has no interest (financial or otherwise) in the childhood home property. however, my sister i can say otherwise – she has an interest in everything. my mother is at the age where she lives on a fixed income and the taxes and insurance are killing her where we live, on top of where she lives. we pay rent to my mother each month to live here, and for her to supplement her income with. we want to set up the quitclaim so that we continue to pay her the monthly rent, until the day she dies or if the state steps in if she were incapacitated. we offered to pay the home insurance and the property taxes, to help us and mom. i want to know what will protect my wife and i, in the event when the time comes that my mother passes away, and my sister (who is on the will – it is power of attorney in the trust) would basically evict us and have us out on the street in a heartbeat – this is no joke. i know she would sell the house and get her part of it and if i were to die, then my wife would be out in a heartbeat too – my sister never liked my wife from the day of our wedding. it has been years for my wife and my mother to talk, due to my sister – my wife loves my mom and they have become closer since moving into the childhood home. my mother complains about my sister to my wife all the time, but my wife cannot do anything to my sister - well because we all fear her. she is intimidating and a downright bully. . the house needs an extensive amount of work since it was built in the early 1920’s, and this includes bringing many things up to code and some things need to be removed due to age and health hazards. my mom wishes the house to remain with me and my wife (when she talks to my wife she always refers to the house as “your” house, meaning our house.) we badly want to fix the house up and live here for a long time – we have so many ideas and plans for this house – yet, the sister recently has decided she wants to come over here and instruct us how to remodel the home – against, the mother’s wishes – and we live here – who will pay for our costs to move out while all the remodeling is done? once she starts one thing – many more will come too. i know my sister. my sister wiped out my mom’s account on the remodeling for the home she currently lives in now, and my mom had to borrow $3000 from my sister – now my sister feels she is part owner of that house and my mother is very down about this fact – so we want to help her pay back my sister to get her off my mother’s back. my sister has her own home, and so does my brother – however, my wife and i don’t have the same income or tax bracket as my siblings and this is why we live in the childhood home and try to help out mom as best as can. sorry for the long ramble...just want to state my case: here is the million dollar question...how binding is a quit-deed and do i have to worry about capital gain or my siblings running this through the court system to get their part? if you got this far...thank you.

Do NOT quitclaim this. Gift tax rules will trip you up. Do this the simple way. 1. BUY the house. Then it's yours and your sister can't meddle.... 2. Have your mom owner finance it. (The interest rate could be 5%.) 3. Instead of rent, you pay her interest an principal. You get the interest and property taxes as a deduction on YOUR taxes. 4. Do this before you've lived in the house 3 years--as she only has a 2 of 5 year window to still claim the $250,000 exclusion on any capital gain. She will have to declare the interest income, any capital gain above $250,000, but not the principal as income. 5. Talk her into getting a will--the will can state that the remaining part of the loan is cancelled at her death or must be your part of your inheritance even if you end up with more "money."

Q. Opening a group home?
i have worked in an all boys group home for just under 2yrs. the ages of boys range from 7yrs old to 17yrs old and there are 3 different house's owned by the company i work for for the three age groups. i do restraints, give medication, transport to school doctors appointments and take them everywhere they need to go. i make them clean up their rooms and take them on their outings when they have $$$ and also work overnights on occasion. i am wanting more out of my job (want a career) and life and i am thinking of opening a group home but i know that licensing is a huge obstacle as there are tons of forms, housing codes, vehichle and insurance requirement as well as other thing i prob forgot about. now on to my question, how much is needed $$$ wise to initally open a group home? i've heard i need to have at least 3 months operating cost accounted for before i can open a group home. that's approx $60,000! needless to say i have nowhere near that amount but i'm sure there is a way since i have the will to open one. i enjoy working with kids even on the crazy days when they act out and need to be restrained or sent to juvie for their extreme behaviors. i get about 9 an hour which is not enough for wut i deal w but its how it is. any owners or admisistrators of group homes that would like to help me out by lettin me know wut i'm in for plz feel free to help me out! and lastly i'm not in it to become a mililonare or anything but i do want to see a profit as i plan on getting married and having a family to support one day... we get about $5,500 a month per child and a lil more if they require additional. services... we house about 4-6 per house and usually have around 5 kids per house. considering paying employees, gas for transportation, $$$ for cloths food and housing upkeep what is the life of a group home owner like?
