When house insurer will not pay? Please please please answer my question. I need someone to tell me the best way to proceed would be much appreciated. I am very grateful for your help. | |||||||||||||||||||||||||||||||||||||||||

Q. Should i buy the house? surveyor said it violate building regulation, but vendor has "completion certificate".? we put in the offer and it is about to exchange. i recruited the surveyor to inspect the house and he said everything is in very good condition, but the loft conversion and kitchen extension of the building do not comply with building control regulation. he said that there is a fire safety issue because there is no protected fire escape way for the loft.
but the vendor said the building work is in compliance of building control regulation. he also had a "completion certificate" issued by the council to proved that the loft conversion and kitchen extension are in compliance.
my surveyor then said that completion certificate may only covers the top floor, but not the ground floor. he also said that completion certificate may only prove that it comply with old building control regulation, but not the updated one. he is very sure that it does not comply with fire safety section. he also said if we buy it, house insurer will not pay us a penny if anything happen. and we cannot resell the house later.
the agent and vendor said our surveyor is overreacted. they said the "completion certificate" is a solid prove and it is issued by district surveyor... our surveyor also said he did consult with the district surveyor and he is very sure that it is dangerous. he even warns us if we buy the house, we are legally liable for any thing happen as we now know the potential problem because of him.
who should i trust?
should i trust the "completion certificate" issued by council, or the professional opinion of that surveyor???
we really like the house. is it true that we cannot resell the house in the future if we bought it?

sorry that i missed this important detail.
it is basically the loft conversion that my surveyor said is non-compliance with the regulation. i checked the details, the loft conversion is done at year 2000. it is now a bedroom.
Sounds like the surveyor is being very protective of his backside to me. You are obviously in the UK somewhere.
How the hell would a conversion in (say) 1999 know what the regulations are going to be 5/10 years on? Regulations change on a fairly frequent basis, you can only work to the regs in force at the time.
What purpose is the loft conversion?
Bedrooms have different fire escape rules to living rooms/ playrooms for example. Even if a bedroom fire doors and smoke alarms come in pretty cheaply.
Ask your solicitor about those completion certs. They sound kosher to me.
You want to be looking at "Approved Document B" (Fire safety). The conversion may have been to version 2000 or before. The current version is dated 2006.

Q. Who should pay poor workmanship costs? builder, insurer or yourself? my ensuit bathroom tiles lifted because of poor workmanship(tiles had been laid incorrectly).i asked persimmon to come and have a look but they said my house 2 years warranty just expired so they cannot do anything about that.
aren't they responsible for faulty workmanship after two years?

Your Question implies that the house was a new build by Persimmon which was completed around 2 years ago.You may have had a contractual warranty from them limited to 2 years after moving in but you may also have had an NHBC guarantee (although that might have only covered the fabric and structure).
Two points to consider 1) if you encounter faulty workmanship you have 6 years in which to sue either because the builders were negligent or the materials were sub-standard 2) if someone tries to limit their liability for what would othwerwise be a 6 year exposure to a 2 year warranty then it might be an issue for the Unfair Contract Terms Act.
If Persimmom have a complaints procedure use it.Make the point that all aspects of the final fix including bathroom tiles should last longer than 2 years.Warranties apart - they promise site inspection and quality assurance before the house is released for sale.In all probability your bathroom was fitted by contractors and not properly inspected/signed off but that is not your concern.You as purchaser are not able to verify these things.
If that doesn't work try your local Trading Standards office.

If a roof tile blows off my roof in a storm & damages my car, do i claim via house or car insurance? thanks!? the house insurer has agreed damage to my roof is due to high winds, but should i claim from my car insurer for the damage the roof-tile has caused to my car's roof, a very expensive repair? i have my doubts that either of them will be battling for the privilege of paying out to me...ho ho! thank you for any help. paul
Your property policy excludes 1st party coverage to your car (just as if your in an accident with the car, your property policy won't address the damage to the car... vehicle is specifically excluded on the policy). Also, liability coverage under the property policy does not cover your car as you cannot be liable to yourself.
So as others mentioned, homeowners for damage to house roof and auto insurance for damage to car.


Q. If my house happened to become damaged and a claim made with the insurance firm, could i carry out the work? if i was a skilled builder with my own sole trading company, could i inherit the work and be 'effectively paid' by my insurer to fix my own property?
UK answer.... can't see why not, they'd want you to get several (probably 3) quotes, of which one could be from yourself.
They may have preferred builders, but again if you can say I'll do it cheaper than they can, why would they argue ? Although they might want you to sign an indemnity release form saying that you are responsible for the quality fo the work
Bottom line, if you can do the same job cheaper than anyone else you're doing them a favour....
Well that's my thinking anyway.


Q. If i pay for a house-sitter to look after my dogs, who's insurance covers my dogs? most house-sitters expect the dogs insurance company to cover them. but legally speaking, they are responsible for the dogs, as handlers.but my dogs insurers say they should have their own insurance.
my dogs do not kennel well & we only have 2 kennels where i live which are both booked up to a year in advance. sitters also care for my fish, etc. i do know that whoever is handling the dogs off the property becomes responsible--not myself, as someone said.my dogs are kept on-lead with them.but it's the insurance should anything happen i'm queerying.

i fully apologise. i'm not meaning to sound arrogant, nor am i a soapbox type, otherwise i wouldn't be asking for advice.
in a nutshell, the problem is between 2 insurances [mine & sitters], having asked them, both want to pass the buck, if you like. not that i think anything would happen, i want to be prepared. is that better?
If the dog sitters are registered with the National Association of Registered Petsitters then their petsitters have £2,000,000 of public liability insurance. Claims are capped at £5,000 per pet and the petsitter is by law responsible for your dog when out in public as the handler. Any accidents in the time you are away are covered by the insurance, vets billed are to be settled by you upon your return BUT the petsitter is absolved of responsibility. You are taking on a professional who is vetted and regulated by N.A.R.P. so you are certain of getting the best care for your pets while you are away. Hope this helps.

What actions can i take if the home insurer tells me to get rid of my dog? my dog recently bit someone inside my house as they where coming in. the bitten person went to the hospital and the home insurance is paying for their medical bills. the home insurers told us that they are gonna decide weather the dog is allowed to stay or not. i dont want to let him go. i dont know wat i can do to prevent this from happening. i live in indiana
Did your dog bite somebody who was trespassing? If that is the case read your state and local law pertaining to dog bites. Many jurisdictions make exceptions for trespassing or if the owner is or feels threatened or is physically assaulted.
If your dog bit somebody because of your complete and utter failure to properly train, socialize, and restrain your dog then you should voluntarily turn him over to the humane society to have him evaluated and possibly rehomed. If you cannot train a dog to not be aggressive and cannot tell the difference between aggressive and protective then you have no business even owning a dog. The dog may very well pay the ultimate price for the owner's ineptitude.
I apologize if I am harsh, but if your dog was not provoked then the fault is yours. Either correct it by consulting a behaviorist and getting your dog properly trained and handled or give up the dog. If your dog was provoked then contact law enforcement and ask them what you can do to keep your dog. And no, walking into the house after being invited does not count as provoking the dog.
Contact a trainer to work one on one with you. Make sure your trainer understands the situation and that euthanasia is not an option and before rehoming you want to try to do right by your dog and get him under proper control. Also be aware and understand that obedience training is more for the owner, not the dog, in order to address the communications breakdown between dog and owner. Google NILIF and put it into effect. Muzzle and leash your dog when somebody is at the door (they can wait a few minutes for you to do this, and can screw off if they have a problem with it :P). A trainer will be necessary, though, for both you and your dog.
In the end if your insurance company tells you to get rid of the dog then you have little choice. If you don't get rid of the dog and they find out they can revoke your insurance coverage and may even make YOU pay an early cancellation fee. If the dog bit out of self defense because the person coming in was trespassing or a direct threat to you and you were severely distressed by their mere presence then you may be able to keep your dog.


Q. My car is a w/off due to fallen tree, t p insurer advised damaged not covered as act of god, dam to hse is ok? it was gale force winds today, i had parked outside my mother's house, the tree from over the road blew accross the road onto my car also damaging two houses. my mother's included. the tree belongs to a type of housing association and had been deemed unsafe by the council and was due to be felled beg of feb. the insurer's are prepared to pay for damage to the two houses but not damage to my car, my insurer's will pay but what my uninusured losses, our excess and cost of a hire car. thanks for any advice
The Housing Trust's Insurer is REQUIRED to cover your car as well.
You were parked outside your mothers home making you a visitor.
Her house Insurance would cover you if the tree was in HER garden.
The Housing Trust is responsible for the tree as it has already been deemed as unsafe. If they refuse to pay, SUE THEM!
I will guarantee you will win (plus get compensation for the time it has taken)
Be polite with all your dealings with them, but remain firm.
THEY ARE AT FAULT!

What to do if house inspector missed a problem in bathroom? we already bought the place. now i've noticed that next to the bathtub/shower, the paint has an air pocket (like it has separated from the wall) and the drywall feels kinda soft. also, the bottom 2 skinny tiles that are on the wall right next to the bathtub are not even tile: it feels like they are paper or plastic or something made to look like tiles. why would someone have replaced tiles with this? also, on the ceiling below this bathroom, the yellowed spot on the paint seems bigger than when he pointed it out. and i noticed a similar separation of paint from wall on a small patch of wall near it. should i be worried? and what should i do? file house insurance claim w/ my insurer, ask inspector's insurance to pay for it?
no, saaanen, he did not point out the water damage or fake tiles. only the small spot. so i'd say it's pretty obvious he did not tell us all he should have.
